RFE but waiting for 2nd FP

I'm sure the regulars are tired of my story but I was wondering if there were many others in the same boat as me.

My RD is 7/02
1st FP 8/02
RFE 11/03

No 2nd FP yet. Is anyone else in the same boat with RFE and expired 1st FP but no 2nd FP notice?

I was hoping for speedy approval after RFE response but nothing has happened yet and it's been 2 months. Now I'm hoping for 2nd FP notice and some progress after that.

Any insights from similar cases would be appreciated.

Also, congratulations to today's approvals! Sorry I have not posted individual congratulations but best wishes to all of you :)

I am riding in the same boat with one of my feet still on shore :).
Dates are similar to yours except RD is Jun 02 and RFE RD is 12/17. 1st FP done Aug 02.
I was thinking that we have the following choices:
1) Keep quiet
2) Check with Customer Service to initiate a status check/send FP2. Dont know whether they would do it ?
3) Get my lawyer to write to USCIS if he agrees to do it, according to him it is upto the officer if FP2 is required ??
4) If none of the above 2 work keep sending USCIS a fax every day. At least I will build a paper trail and can use it if my case gets delayed beyond 3-4 months to contact senator/congress man.
5) Apply for renewal of EAD and AP sometime soon, they are valid till Jul 04. Maybe that triggers something.

What are your thoughts on the above ? Does your lawyer say anything about FP2 ?

Did you file AR11 during the 485 process ?

I really fail to understand the big DEAL about 2nd FP. If it has not come, then why are you worried. When it comes , do it...

My receipt date is Aug 01. I am on the 4th EAD and 4th AP now. Interview is complete too on Nov 2003. Stuck in Security Check....
Got to live with it...

Unfortunately my lawyer is not terribly helpful. So I have not talked to them about it. I will probably apply for EAD renewal sometime in February as I think 4 months in advance is good, right? That might trigger something, hopefully.

I don't know if I filed AR11 - I'm not sure what that is.

One of my frustrations in the whole thing is that my company would not allow me to do consular processing. They assured me that my case would move just as quickly through this method.

SWaiting, I'm not complaining really or stressed out about 2nd FP. I just don't want my RFE to be processed then a delay to happen because oh, then they realize my FP has expired. You know?

No. I haven't changed anything (job, address etc) for fear that it would jeopardize or delay the process. No AR11 filed.

scotgirl: You may have a problem as they find your records in the US-VISIT but they cannot find any consulate records/visa records since you re-entered with no visa but AP. Between serious and joking..US-VISIT tries to compare the entry record with the consulate/visa record, this is no joke.

2nd FP may not be needed

I was going through the posts here and some people have been approved even after FP expiry ( month or two gap).
also my colleague had his FP expire in June 2003, had interview in October and was approved without 2nd FP.
so everything depends on adjudicating officer.
I am seeing many people being approved 1-2 month after RFE reply.
 
It concerns me that you think I might have a problem because I was fingerprinted and had photo taken upon entry. This was at the request of the officer so therefore was his mistake.

I think I also noted that he had me fill in an I-94 which was not correct as I was entering on AP. I really hope this doesn't cause me any problems.

We all have different concerns wrt all these. On a scale of 1-10 your worries should be at a 4, I think. They have so many different databases with inaccurate information and they are trying to use them before adjudication. This is the real problem. It is also not fair. Wrt the US-VISIT, it is still under constuction with designating EXIT ports equipped with it, etc. So I guess when you exit from a port equipped with it, what do you do? Go through it again as you are there already or not? You have no visa/consulate record also, so the computer intelligence will capture this??
Oh, now they are introducing CAPPS II which gets information from the airlines and assigns a threat color to passengers...
