RFE and pregnancy

Hi,

I got an RFE for my employment letter and asked my wife to get the TB skin test and/or chest X-Ray.

Initially when we field I-485, the INS doctor did not do skin test/chest X-ray because two years back she got treated for TB for 6 months (then her skin test was +ve and X-ray was good). The treatment was supervised by another doctor and we provided all the documentation to INS designated doctor.

The problem now is, she cannot get these tests done because she is 3 months pregnant.

How does this affect my I-485 process? Does the INS clear my case and put my wife's case on hold till the delivery of the kid?
Or Does both of our cases will be on hold?

Is anyone aware of this situation?

Thanks,

This is a tricky situation. As i understand BCIS will not clear your wife's case till she is vaccinated as per laws. But that should not hold your case as all these cases are treated independantly.

Now if in your case your wife i sprimary applicant then they acn hold all the cases till the primary applicant is approved.

Why you did not complete the medical within those 18 months well before she got conceived?

Your lawer can help you more with different ideas.

I never anticipated that INS would ask for skin test/X-Ray in RFE. I thought that the skin test/X-Ray is not needed because she took the complete treatment and we povided the documentation to the INS certified doctor. It was the INS doctor who said that these TB tests are not needed.

I hope everything goes fine in my case.
