RFE and I-485 Questions

Hi to all,

Anybody on the I-485 case pending and received RFE regarding the new/amended 140 (company merger/buy out) have their case approved after sending the new I-140 case? Thanks.

140 AVM says this type of case take 55-60 days to approve.

485 is still pending. Lawyer started my 485 with EB3 I-140 and later amended it with EB2 I-140 approval notice.

I beleive once our 140\'s get aproved, the 485\'s will get approved. Yes both are interlinked, need 140 approval to do anything with the 485 case.

Nothing happens automatically @ INS. I would be shocked to say the least if 485 gets approved same or next day 140 gets approved.

Hey Guys,
   In my case I already had a new approved I-140, but the INS as always were not aware of it. My lawyer just sent in the approved I-140 and the message was updated stating that the INS has received it on the 13th of Feb, 2001. I talked to an IIO on 02/24/01 and she didn\'t give me any timeline, but said that everything looks fine in my case and the approval time depends on the IIO to which my case is assigned to. Do you think the INS will approve my case soon?

Hi guys,

I am a same situation.
I have also new I-140 approval, so after I got RFE for the new amended I-140 due to company merger, we sent approval notice but nothing happen yet. My detail as following.

I-485 RD 8/14/00
ND 9/5/00
FP 11/3/00
2\'nd FP notice which was scheduled 1/25/02, but ignored
EAD/AP got approval.
RFE for amended I-140 1/18/01
We replied RFE(sent approved amended I-140) 1/19/01
INS AVR indicated received RFE on 2/6/01

Now I\'m waiting and waiting....

Hey, Guys guys, I\'m in the same situation. Looks like INS is sending out lots of RFEs regarding to company change names/merger, etc...All of our RFE happened in Jan, 2001. This is annoying as AC21 allows people to even change job after I485 submitted 180 days. Obviously INS is trying to give us a hard time before the law finally takes effect and they have been pushing it off.

I have sent the amended I-140 application on 2/16. No response yet. AVM is not updated. Please update you case status. Wish we can all be lucky this time!
