Hello,

A friend of mine has gotten an RFE on some of the information given in his G325. He has gotten some information wrong with regards to the time he has worked and time he was in school etc. He hast made an honest mistake, how does he go about correcting and resubmitting the G325(Biographical Information)? He will be able to submit proof to support the amended forms.

He is scared witless and any help is greatly appreciated.

Thanks,
G

He is not the only one I believe many of us have errors in 485 pettition, noone is perfect. all he need to correct

use attorney to reply or response. no personal reply

Good luck

He needs to make the corrections in good faith and await the results. If for any reason, any of his changes were interpreted to be genuinely constituting a "suppression or misrepresentation of facts" that could alter or influence the outcome of any adjudicatory decision, then the case may be transferred to the local office for interview and further adjudication. In a worst case scenario, a notice of intent to deny (NOID) may be issued as well. However, if the changes were not significant that would have altered the original outcome, then your friend may not even have a local office transfer and just have a positive adjudication.

Example: Suppression of a material fact like an arrest record or marital record may constitute penalty of perjury; whereas, an erroneous date or initial or an accidental YES for a question relating to TB/HIV etc., may not be as serious as you might think.

I hope so. He basically put by mistake that he worked for 5 years with this current employer whereas, he took a 4 month break in his first year when he was in his last semester in school.

Basically INS or whatever it is called now asked for proof that he had permission to work which he did not have nor did he work. His concern is he has put the contigious 5 year block both in his labor application and the G325 and he is concerned that his labor may get rejected. His boss has offered a letter to tell that he did not work then and further, he was also registered for a full 20 hour load of classes at that time.

I hope all of this works out well for him. Thanks for your thoughts, any other feedback is also appreciated.
