Hi folks, I filled for my wife AOS On Dec 23rd, 2008. She got her AP ans EAD card on 25th of Feb 2008. USCIS sent her RFE in Jan and we sent it back on Feb 3rd and that is las LUD on her I485 which said that we have received you answer and you will be notiied in 60 days when the deceision will be made. My question is that no 60 days are over and i didnt received any update on her i485 i also called at customer services and talked with IO she also told me that your cae is with National Benefit ceter and still is pending. so what you guys suggest should i go for that Info pass to find out wot is going on with the case.

That happen to my and they took 125 days instead of 60 days before they sent me the interview letter.

So be patient before you make any decision and about the info pass i did two info pass and they told me the same thing that was in the uscis.gov web site.

our RFE went on August 2008 yet every month infopass she tells us we got the package we will inform you soon.
its like that for what last 7 months?

I am the same boat. I am going to take an infor pass. Should I select the following option?

"Case Services follow-up appointment - If it has been over 45 days since you contacted NCSC and have not received a response to your inquiry. You must bring the Service Request ID Number related to your inquiry to the appointment."

Thanks

Yes I have made the 8th of April appointment, and i discover the intresting thing today, i called to USCIS customer services and they transferd me to the next level the lady told me she is an officer( beleived IO), She told me that my case is still with the MSC and i have to wait and still its not in the queu for the interview. Any sugestions...?

Are you a GC or USC? only GC petition their spouse will have to wait for a visa to be available which is why your case is at NVC waiting for a visa to be availabe for your wife. After a visa is availabe, USCI will then continue to process your case

sorry..didn't read that carefully. 60 days is just an average processsing but most of the time, they will not able to meet that timeframe. You can either schedule an infopass and talk to and officer or give it another month or two.

It is true what bestpal say....

They always take a little longer some cases they meet the requirements earlier than the timeframe they set but sometimes they go over it just like it happen to me almost a month after the 90 days wating period they set for me to get my EAD
