I guess RFE is on the way....

1st FP was Apr 2002... I havent got my 2nd FP yet...

Mine is an interesting case... I moved out of US by August 2003 but still working for the same company just the Indian counter-part. I have been with the same company for the past 5+ years. The company and attorneys said since GC is for future employment there shld not be a problem and my company has promised to give employment once GC is approved...

Will keep this site updated on the happenings of my case...

RFE Details

· Copies of Forms W-2s (for years 2000, 2001, 2002, and 2003) documenting wages paid.

· Copies of three most recent paystubs in 2004

· Copies of Form 1040, (including all accompanying W-2, forms and schedules) for 2000, 2001, 2002, & 2003.

· Letter from company verifying that they are still offering you the position as described on the I-140/AEC. USCIS has also asked that this letter include a “typical day” description of the duties, the hours to be worked, and the salary/wage to be paid.

· USCIS has asked for evidence of employers ability to pay the offered wage, both now and since the time of initial filing. This can be demonstrated with annual reports, federal tax returns, or audited financial statements.

· For tax years 2001, 2002 & 2003, copies of employers filed federal tax returns, IRS Form 1120, including all accompanying filed forms and schedules. The tax returns should bear the stamp of the IRS.

All these need to be submitted by June 9, 2004.. USCIS I guess gives normally 3 months to respond to an RFE...
