Revalidation Refusal

I send for revalidation and was refused and was told to meet a consulate officer ( that is my home country ).
I had visa reneved and is approved till december 2005. But i send for my revalidation after one year . So the reason they mentioned is that its more than one year and they cancelled my visa in the passport " VISA CANCELLED WITHOUT PREJUDICE "
I would like to know, how soon i should go to the home country and do the revalidation. Or i have the choice of doing it when i go for vaccation later . Will this make me ILLEGAL . I dont want to be ILLEGAL at all .

What do you mean by visa renewed and is approved till Dec 05? Is it your H1 approval notice's validity date? What is the validity date of your visa stamp. As long as you have a valid I-94, you don't need a visa unless you are planning to go out of US.
 
Revalidation

what i mean reneval is that - i got my petion approved with an I94 From jan 2003 to dec 2005.
When i applied for my revalidation in St.Louis, i got a 22i (g) paper ( its states that told to meet a consulate officer )along with the passport in which my old visa stamped ( which was valid till jan 18th 2003) was cancelled - " CANCELLED WITHOUT PREJUDICE "
I would like to know because of the above - should i go to the home country and do the revalidation immediately to become legal or i am still legal and i can go for revalidation, the next time when i go to India since my Current I94 is valid till December 2005
 
You are not out of status. DOS will revalidate a visa if old visa have not expired more than 1 year ago. Since you applied for visa 1 year after expiry of earlier visa, DOS in St Louis can't revalidate and asked you to revalidate in consulate. It is usual for DOS to cancel expired visas in passport if it can't be revalidated. 221(g) is a general clause used by DOS. So don't worry and get new visa while visiting India.

You can also take the advice of your company attorney in this matter as 2nd opinion.
