Returning resident permit

Hi Friends,

I applied for RRP in January 2004 for myself and family, havent received that yet, if i check online, it tells that the process is taking 400-450 days.

1)Is anybody in the same boat?
2)is it normal?
3)since I am still in US and havent got that yet, can i re-apply again ?

I need your inputs

I just applied a few weeks back. I had asked for the Approval to be sent to the US Consulate in Chennai, India. The approval notice will be sent to my friend here in the US. I will also check the status online from time to time.
I intend to leave the US by the end of the year. However, I will travel back to the US within a year if it has not been approved as yet. I may even consider coming back once every 6 months until the REP is approved.
You do not need to re-apply for the REP, since the approval time is typically over a year for approval and it is valid for 2 years from the date of approval.

Some Qs here,

1. AJ-USA, Why do you need RRP if you ar ein USA? My understanding is, Retruning Resident Permit is required to those who went out of US and overstayed.

2. rg585 - ReP does not need to be approved before you leave country, right. Then Why do you have anxiety about its approval? If it is denied then you can worry but the first time you apply ReP it is very unlikely that it will be denied.
 
Thanks for your replies. Actually I applied in Jan 2004 ,went to India on business trip, came back to US again. This time, I want to go back for sometime till I get the RRP. I have given my friend's address here.
Since I am here now, i was wondering if I can apply again or the application I sent earlier is fine enough, so that I can go back to India now and come back when RRP with a return date is granted.

Yup, I do not need approval before leaving the US.
I may not even come back to the US if things work out well in India. I am just wondering how I can then travel to the US for Business visits. My attorney had told me that I could go to the US Consulate in India and tell them that I do not plan to reside in the US anymore and they can give me a Multiple Entry Business Visa to travel to the US once in a way.
 
Thanks Joe. Is this only for US Residents based in UK? Maybe I can fill out the same form and submit to the US Consulate in India and at the same time, they can give me a B1 visa for 10 years.

A word of caution though. It is no gaurantee that you will be given B visa or any other non-immigrant visa once you had shown intent to reside permanently in US. Someone I know had a problem. His wife was denied any visa when she had left to India abondoning her GC. Luckily, her husband staying with her in India had his US citizenship so he got her GC back.

I am always of opinion that lawyers can advise anything but no one can gaurantee. In the end the person who suffers the most is not lawyer for sure.
 
Could anyone here please tell me why RRP is required? And in this case, why Aj_USA is looking for one when he is already in US?

Thanks. Will keep it in mind. Well, in my case, I would be surrendering my GC, not really abandoning it. I think there is a difference between the case that you have mentioned. Not doing anything with the GC after leaving the US can be considered as abandoning the GC.
 
So RRP Returning Resident Permit (RRP) is same as Re-Entry Permit(ReP), is it?

I was getting confused between RRP and RRV (Returning Resident Visa) that is available in US Consulates abroad who over stayed beyond their control and now trying to re-enter US.

Hypothetically, if the case is rejected after one year and 3 months, can you get back to US? The actual absence is one year and 3 months. But since you came back once within one year, will they consider your absence as 3 months and allow you return without reentry permit?

Re-entry Permit (ReP) does not need to be approved before you can depart. You just need to apply in US and leave.

If it is a first time that you are asking for ReP then it is rarely denied. Your GC is valid as long as you travel back within a year and prove that your stay was temporary in nature and you intend to reside permanently in US.
