returned to india after 5 years of h1B. when can I apply for new 6 years of H1? Do I have to wait 12 months before the petition is filed with INS for new H1b or can the petetion be filed after 10 months (as H1B pettetion is taking 3 months now). I came 10 months ago and I have an employer ready to file for my H1B again. The visa on my passport is still valid for next 1 year. Or should I wait till 12 months after the visa expiry??
