Return of KCC Forms - June OK ? (DV2009 Winner)

Hi Guys,

I am a winner of DV2009 from Asia, with a case number of 39XX. I have just received my NL last week. My partner and I are planning to get married in June, so is it possible that we return the forms to KCC by June in order to include the marriage cert ? Will returning the forms later affect my chances, or is it only dependant on the case number ?

In the original lottery application , I have stated myself as married and put in my partner's name as spouse as we're planning to register our marriage this year

First of all congratulation, taka a time get married and later you can send the forms in june or july... it all matters from the case number. And you have nice one, best of luck.

You stated yourself as married and wasnt? Wow, chances are very high that they will disqualify you at the time of interview because you made a false statement in you online application.

wops I didnt read this before, it seems you have just s...w you chances for GC. so sad.
 
Well I have been getting conflicting views on this one
Some say that I have to add in my partner as married in the original application else she will never get the GC even when I get married later

I've contacted the US consulate in my country and they ask me to put her in as spouse and as long as I get married before the interview date, it's fine

Does anybody have any direct experience on this ?

I' m pretty sure they also tell you G.W. Bush is a good president if you ask them :p

Ooh my gosh. U are so funny. Sometimes when i speak to different USCIS customer service reps, i could swear that i was talking to people that work in totally different departments and have varying answers to a very simple and specific questions.

I am in support of what the other guys said; I think you shot yourself in the foot in taking wrong advice by making a false declaration in your original application. If someone from the US consulate told you that it is alright so long as you get married before the interview date, then better pray very hard that person will be the interviewer on that date.
The chances are very high that you will be denied the visa at the interview due to this false information made in the original online application.
But who knows ......., maybe, your case might become an exception, so the full decision to carry on with the visa process lies in your hand.
 
Good Grief! Is this true? My husband and I stated on our online application that we were married (we were defacto at the time) as we had lived together for nine years and filed joint tax returns etc. We were actually engaged when we applied, and got married in September 07.

KCC said nothing when we sent off the marriage certificate, they actually said that all the paperwork was in order and ready for continuing the process!

I'm in the same situation as you - De Facto - Together for 8 years, engaged, just not legally married yet. I'm trying to find out from KCC now if there is any issue with my case.. I'm just worried they will question during the interview as posted by some forum members here

Anyway, I would call KCC or the Consulate for advice. However, the lottery regulations specifically forbid putting false information in any of the forms you have to fill out, including your initial application of course. Stating that you're married from the start of the lottery when really you're not, is false information that can be verified easily. I'm not sure if it's enough a ground for disqualification, but they give you plenty of time to get married after you receive the NL. I believe you can add a new spouse and any newborn or adopted children to your application just as long as you let them know before the interview. People's lifes change constantly, sometimes over the course of a couple of months, and they know that we're not robots. So I really don't know why you put 'married' in your initial application. There have been plenty of people here and on other forums who got married after they received a NL, and consequently got a visa for their new spouse without any problems. You just have to prove that your relationship is genuine, that's all. In your case, I don't think that would be a problem.

I put in that I was married, but then that was "common-law" marriage. We got our marriage certificate after reciving the NL. Are telling me that they don't recognize common-law marriage and therefore my declaration in my application was "false"?
