Retrogression Vs Visa Unavailability

Hi,

What exactly do we mean by retrogression:
1. Is retro related to 140 filing OR 485 filing or BOTH?
2. In retrogression situation, which form we can not file - 140 OR 485?

What happens if retrogression occures AFTER filing 140- 485.
1. Does the 485 processing still continue?

Retrogression means visa still available but demand is higher than available visas - so they set cut-off date.

Visa unavailability means they are out of yearly quota, in this case FS 2005. Visa will be available from next fiscal year, i.e. FS 2006 - Oct '05 to Sep '06.

--- it is related to I485/EAD/AP. You can still file I140.
2. In retrogression situation, which form we can not file - 140 OR 485?

1. Does the 485 processing still continue?
--- they will stop processing your case, through you may get finger print, etc. They can not adjucate your I485 until your PD become current.
