Retrogression - Priority date Or Labor Approval date?

I came across a person today. His company applied for his 485 using the Approved Labor of another Laid-off employee. The Labor had a Priority date of year 1998 and Approved back in 2001!

Does USCIS not ask that if someone had thier Labor Approved even 2 years ago, what was the applicant doing all this while? Sleeping? No ! obviously it implies that this Labor was "transfered" by the organization to another new comer. Now this "new comer" would be working for 48k (most often the case in consulting corporations or to attract new hires, the incentive is not " we will sponsor" but we will give you a pre-approved labor") just so that he can get this pre-approved labor and get her/his GC. While we are all Waiting.

Makes me think that everyone in USDOL is pea-brained or deliberately encouraging consulting corporations to exploit employees. Let's accept the fact that we too would have accepted the same offer if an organization stated" You work for 48k and get your GC fast. You can always make the decent industry standard wage after you get the GC"

Who benefits? The organization. They now make more money from the guy by trading thier "un-used "labor application. Rarely it is the later case that is attracting new hires.
