retrogression is official ?

Hi,
I saw in other immigration site that 485 retrogression news has become official and actual retrogressed date is Jan'2002, starting from Jan'2005.
Now I am in bit confused state. I am using substitute labor whose PD is Sept' 99.
I have seen conflicting statements in the forum regarding PD attached to substitute labor. Some say PD will be date when I-140 was filed, others say it is actual date i.e date in which labor was filed. Any confirmations ?

Also in my case, I have even got RFE for 485. Also got RFE on I-140. Can I assume that my case will move forward irrespective of retrogression and PD ?

In your case, the retrogression will not have any effect as your PD is Sep'99.
My friend , who also applied 485 using sub-LC, confirmed his attorney today that his PD is what is stated in the sub-LC.

YOu better confirm the same with your attorney.

Pls if someone could let me know what would be my priority date.

1.)I filed my orginal labour certification in July'2001 and it got remanded to Sate in Jun'2003 and is still pending.

2.)My lawyer filed my I-140 using substitute labour in Jan'2004 and priority date of that substitute labour is somewhere in 2001.

What would be priority date.Would I be the unfortunate victim of this retrogression.

I am yet to file my I-485 and my employer has no plans to file it before Jan 2005.

From what I understand, I think retrogression only applies to the I-485 or CP priority dates and not the I-140 or the LC. Can someone confirm ?
 
My question was regarding my priority date.Would it be the filing date of the substitute labour I used or I-140 application filinf date.

Try to file I485 this year. I don't think it has anything to do with your company. If you already have your I140 approved, and haven't filed I485 yet, I think it's time to do so. Your company can not hold you back anymore. At least this is my understanding.
