Retrogression and life dilemma -- please help

My I485 pending since July 2003 due to FBI name check pending. I regret I didn't do more to speed up the name check like filing a mandamus etc. Now there is no guarantee when I will get my GC. All my career plan will be on hold.

My PD is Dec 2001 EB2. I planed to go to B school next year. It seems this needs to be on hold. My current job is a dead end job. If I want to Use AC21, could I move to a different region? Will VSC continue to ajudicate my I485?
What promise I need to get from my future employer to keep my GC alive?

Can I expect my GC in a year?

Get your story out

I know this doesn't really help you immediately -- but your kind of story needs to get heard.

If USCIS was processing things in a "due process" manner, you shouldn't have been stuck in a name check since 2003, visa numbers would have been current and you would have your green card.

I am in the same boat like you and share your pain but I think even DOL is not in a position to answer your question "Can I expect my GC in a year?"

I am assuming that you were well aware that "Being on H1B in US is not a guarantee to be GC holder" and I am also assuming that you do not want to return back to your country. Mostly I do not see any problem for your employer to keep your GC file "alive" in case any worst situation arise if you are in their "Good Book".I would not waste your and my time about answering US GC questions.. Belive me that has already become useless path. Only one suggestion: If you are so fond of and determined to make career plan in "North America" then Canada is an option to consider. Have you ever tried for that?

And do not regret about this situation because the fact is that whether you get GC or not it is not under your control and practically speaking we even do not have right to dream about "Time limit" , only right we have is to dream about "GC" but not about achieving in certain time limit.

Cheer up. I am understand your situation, since I am in the same situation with similar aspirations. You already have an EAD and AP. Keep renewing it, hope for the best and start the B-School. You have nothing to lose. I am going to do the same. Grin and bear with your current employer until the V-day. I am sure this gloom is temporary and things will be OK pretty soon.

Yes LCSilence, things are good for you. You are almost there.Hold on and why dont you inquire on a regular basis even now.I am an EB3 with PD Jan 2003 and my I-485 is pending to be filed ! I am headed to India to get married but really in a dilemma whether to come back or if I do I dont know how long to continue.

If you employer covers cost of the b-school, take advantage of it. In my case I am 50% oone with the b-school, but I am slowing down now because my employer doesn't pay for it and I figured that it is too expensive to pay the school as a non-resident. Paying 50K for an MBA program... if I had the GC, would pay less 20K + possibilities for scholarships. No way.

LCSilence, I would be careful about the implications of going to school till you haven't adjusted to Permanent Residency status. I believe you will have to get an F1, and that if I am not wrong would be construed as abandoning the Immigration petition.

You are very close, What you might do is go ahead with the B-school application process, and if the GC doesn't come through by next fall, try to get the admission deferred for one year. I know friends who did that back in 2000 (He was in the same boat)

BTW Marlon-- things might have changed in the last 5 years, but I don't seem to remember any B-school (atleast the Top ones) who had diffrent tution fee structures for Permanent Residents vs. Non-Immigrants... The only diffrence used to be at State schools, where there would be an in-state vs. out-of-state fee structure...
 
I study at a State university and the non-resident fee concept is alive and well. Not only the tuition and fees cost me an arm and leg, but also I have no access to scholarships opportunities. Ironically, the specific school I am is very rich in scholarships for minorities, but you must be a permanent resident or citizen to take advantage of them. Student loans are also limited for people without a GC. Ironically, my bank approved a $200,000.00 home loan for me three years ago. More recently, they denied a $20,000.00 student loan application because I am not a permanent resident yet. Does it suck ?
