Retrogression and Filing before Sep end

So, in the light of the new horrific retrogression numbers, I just wanted to confirm the fact that as long as my application reaches DOL before the end of Sep, I am fine, right? And I wont be negatively affected by the retrogression. My labor was approved last month and the lawyer is working towards filing the 140/485 concurrently.

If you file the I-140 and the I-485 before the end of Sept. you get the benefit of also being able to apply for the EAD and AP. (these benefits come from being able to file the I-485).
BUT you will be affected by retrogression. Your priority date is May 2003. (the date you filed the labor with the state). They will not touch your I-485 until there are visa numbers available for your case. If your priority date is before the cut-off you are fine. If your priority date is the same or after the cut-off they won't process the I-485. It does not affect I-140 processing.

thanks for clarifying this for me. Although it is really hurts me to read that case wont be looked into...but atleast the good thing is that I can atleast get the EAD and AP. Thanks once again. Will hope for DOL to reach Mat 2003 soon.
