Retro victims with Canadian PR, please comment.

Hi All,

I have the canadian PR that is valid from Jan, 2006 to Jan 2011. Within that 5 yr time i will have to wait for US GC and also if somehow i am not able to get it then i should better have a plan where i get my candian citizenship. Here is what my plan is :

1. I find a job (that is a big if but lets assume here) in Detroit, MI area.
2. I move to Canada(Windsor) physically and do commute to the work.
3. After 3 years i will get my canadian citizenship and may be my US GC.
4. Meanwhile i apply for my parents' canadian PR.
5. I get my parents' canadian PR in couple of years.

So after say 4-5 years i will have the canadian citizenship and/or US GC and my parents will also have the canadian Gc and they can live very near to me or with me.

Here are my questions :

1. If you move to Canada but commute to US for work (lots of people do that, i 'heard' it on internet !) does that count toward your "physical residency requirements" ?

2. Do you need to transfer your current I-485 application to consular processing ?

3. What will be the impact on my US GC application if any ?


I think it is a loaded question but i am trying to think about a solution to this problem rather than wasting my time in "predictions" and "venting my frustration".

If anyone has done this or thought about this please comment. May be soem brainstoring will lead to some loose solution that is better for us than to wait and get frustrated.

To maintain Canadian PR you need to live in Canada for 2 out of every 5 years. So that mean you can live out maz 3 yrs. That means you will need to move latest by Jan 2009 or you will loose it.

Canadian PR applications for parents is heavily backlogged. Though possible to apply for parents on PR it could take 5-6 yrs. Its not 2 yrs anymore. Plus depends on parents health. If parents have serious health problems PR will be refused as Canada doesnt want people coming just to use free medical. Also after 3 yrs in Canada you can apply for Citizenship. Processing time is 12-18 months so you are actually looking at 4-4.5 yrs before getting passport.

Yes it does. Ofcourse you will have to file both US and Canadian taxes. Will have to drive car with Canadian license plate, get canadian drivers license etc.

I have heard that you dont need to, but you may wish to check with lawyer. You could tempo move to detroit though once your PD becomes current.

3. What will be the impact on my US GC application if any ?

I have studied this. It is possible and workable. Be ready to add half an hr to daily commute for border checking. First find a job in either Detroit or Buffalo, NY. You can do this if you get job in Buffalo also if you live in Fort Erie, ON.
