Resume abandoned application

Hi,
My sister is a GC holder (primary applicant). Although my brother-in-law was a spouse applicant with my sister's GC application, he had to leave the US
indefinitely on a medical situation (father's condition). This happened
while they were waiting for adjustment of status(more than 180 days of
I-485filing). He traveled on advanced parole which later got expired
(while he was in India) and he did not apply for the next. My sister continued to maintain her status in US and finally received her GC in Jan 2004. My Brother-in-law was unable to resume any correspondence due to family situation as his father was terminally ill (passed away in Sept '04)

My question is whether is there anyway to resume his abandoned I-485 application ??

Merely staying out of the US does not mean that the 485 application is abandoned. Did he fail to respond to any RFE/fingerprint notices? If not, the application should be approved.

the case was transferred to local office and the interview was in Nov 2003. My sister appeared for it and got the GC. He couldn't come to US as advance parole had expired... so he didnt appear for the interview...

My sister did appear for the interview and she got the GC in Jan 2004...

I think he can interview in the US consulate in india. As long as you don't get a denial, you can convert the 485 into counslar processing.
