Response from USCIS on I-485 inquiry - Concerned

Hi all,
I initiated an inquiry with Vermont USCIS almost 3 weeks back and got a response as under. Any body seen like this before?
140/485 - RD 12/05/2003
140 Approved - Jan 9th, 2005
2 LUDs on 485 (First one 9/11/2004 and Second 02/01/2005). I have active EAD and AP.

Response as under:

The Status of this service request is:
Our records show that this case is currently pending due to the fact that the visa is not currently available. You may obtain information on visa availability by calling the State Department at 202-663-1541. You may obtain general visa information by calling the State Dept at 202-663-1225. Information concerning the "Visa Lottery" or the "AA-1 Program" may be obtained by calling the State Dept at 202-663-1600.

What's your PD?
 
Visa not available

It means that if you are a national of China/India/Philipines or a fourth preference in labor application your I-140 priority date is not yet current.
 
Vermont issue

I called State Dept based on the letter from Vermont and they told EB2 is current and Vermont may have made a mistake. So I guess I will have to call Vermont and check with them again.

Can you tell me how do you initiate the inquiry? Do you do it through lawyer or DIY? My case is Nov 2003 and I need to send an inquiry also but I hope I can DIY. Do you have any sample letter?

Inquiry

I just called USCIS and told them the dates are past my RD date. They asked for my Alien # and Receipt no and initiated the request from their end.

To the rest:
I called USCIS again and told the state dept says my EB2 is current and the letter says "Visa not available" may be incorrect. So USCIS said since u got the letter from Vermont only y'day, I would have to wait for 60 days before I call again. This is weird. There could be mistake on the Vermont side and still they make us wait for 60 days. Rediculous.
 
Called VSC

I called VSC and a very nice courteous lady was online. I explained to her my issue (Vermont made a mistake) but in a subtle way. She went through some details on the computer and put me on hold for almost 10 mts. Then came back and said it was our mistake and ur case was in an "no visa" bucket. I have moved urs and ur wifes case to "EB2" bucket for review and should get picked up by someone soon.

I said thank you and hung up.

Can u please give the no to VSC. Your help is appreciated....

I looked in the message earlier you had made a Query through USCIS
and then I saw another message saying that you called VSC so did you make 2 calls is that right...
 
USCIS and VSC

Hi all,
Yes I made 2 separate calls. First I called USCIS and gave them the details about my status. Since I got a letter related to inquiry y'day, USCIS asked me to get back to them after 60 days. That would reflect in my frustrated response above.

Then after an hour of thinking, I called VSC. How to reach VSC? Well it's the same number that you would use to call USCIS, but follow different voice prompts. Infact how to reach VSC is in this forum. Please follow up on that...

Then once the VSC person came on the phone, I explained the status and rest is posted above again. Thank you.
