Response from TSC after transfer

As I had indicated in one of my earlier posting, my I-485 case was transferred from VSC to TSC on 03/07/2007.

Today, I received a letter from TSC in response to my case status inquiry which I had submitted to the customer service representative back in late Dec. 2006. For a change,the letter this time does not have the usual security check pending stuff.

This is what the letter states:

"Your application was received at the Texas Service Center and is currently pending Service consideration. If you have not been scheduled for biometrics appointment,you will receive an appointment notice as soon as there is an available date and time at your local ASC office. Due to backlogs at some sites it may take more than 60 days for the appointment to be scheduled."

I do not know whether my name check is still pending or not. My name check was still pending as of early Feb, 2007 (as per senator's office) I had sent a letter to the First lady in mid-Feb, 2007. I haven't received any response to that as yet.

We were fingerprinted back in August 2005 - I guess we will now have to wait for the 2nd FP notice.

can u tell what is the date on the letter taht u got?maybe the LUD that u got lately in late march are bcs of that letter.

it will be nice if u check through infopass or call TSC to see about ur namecheck. maybe the first lady helped u in clearing it. what do u think?

My attorney received a letter today from the USCIS today stating that my name check is still pending. This time it was a letter signed by a Supervisor from the Customer Assistance Office, USCIS. This is what he wrote:

"Thank you for your letter dated Dec. 19, 2006 to USCIS ombudsman. Your letter concerning your client's Mr. and Mrs. . . 's I-485 . . . was forwarded to Customer Assistance Office for a response.

Mr . . . 's priority date has been reached and visa number is now available. However, his name check is still pending and until the investigation into his background is completed both cases will remain open. Mr. and Mrs. . . 's I-485 applications were transfered to Texas Service Center on March 7, 2007 for processing. The Texas Service Center is currently processing I-485 applications received on Sept. 13, 2006.

The name check is required to be completed on all applicants who apply for the immigration benefit that Mr. . .. is seeking. We will make every effort to make a decision on his case as soon as his name check is completed. Please be assured that once all of the information has been received on Mr. . . 's case, their cases will be continued.

In the Department of State's visa bulletin for March 2007, visas are current for Employment based 1st Preference, India. Mr. . . 's priority date is January 31, 2005.

We trust that this information is helpful."

what is the date on ur letter? maybe by now ur namecheck got cleared bcs of the FL. did u hear anything back from fbi or first lady office since u sent ur letter in mid feb?
 
The date on the USCIS letter that we received today is pretty recent - March 28, 2007. I am a little confused.

The previous letter from the TSC (dated March 26, 2007) said nothing about name check - just mentioned "pending service consideration" and that I will get biometrics notice soon.

from what i realised about sending letters to First lady that thw whole thing takes around 3 months.

it takes around 4 to 6 weeks for the first lady office to process ur letter. and another month for FBI to look at ur NC and either clear it or say it is pending then 2 to 3 weeks for the fbi letter to reach ur place.

so in ur case, u sent the letter to FL in mid feb, then fbi will receive ur letter between mid march to late march then they will do something with ur NC around the 15 to 30 of april then you should hear back from fbi by letter by around 15 may.

so my point is that maybe in few days, fbi will clear ur NC. once it is clear, it takes around 3 weeks for USCIS to update their database about ur NC.

so honestly, i don't expect that ur NC got cleared yet but it will hopefully in few weeks. hope this clarifies things. let me kniw what happens with u.
 
Status: Security Checks Still Pending

I spoke with TSC-Rep yesterday, nothing new, no progress. My security checks were ordered on 12/22/2004. No clue, when FBI will pickup my file to perform these checks. I am sure checks are not being done on FIFO basis.
Looks like I have to wait next several years.
