My H1 was due to expire in Nov 2006 and I applied for 7th year extn in Oct. Received RFE (very extensive with 13 items) in Feb 07, submitted all required documentation on April 28. How long does it usually take to get a decision response from CSC? Please advise..

Thanks,
Binu

Usually it takes about 3-4 weeks for USCIS to make a decision. But now its taking much longer than that. I got the same RFE and the documents were received by the USCIS on May 11 2007 and I think it is going to take a while cos I there has been posts by other members who are waiting for more than 120 days after they submitted the documents. I think CSC has too many cases in H1 to process.

Is Receipt enough for parents' visa application?

Thanks, pal. Do you know if the Receipt that I received when I filed the extension of my H1 is valid enough to apply for visitor's visa for my parents?

Visa extension receipt notice makes you not out of status, so I think that should do for sponsoring your parents' visitor visa. I dont see a problem but I may be wrong. Check the requirements in the B1/B2 category and if they specified that you need a "valid visa" then it becomes a problem. Good luck. And please post if you get any updates on your case and I will do the same.

Devar & Binugopi,

I got the same RFE as yours. Could you please let me know in you how long USCIS took to update your status after you sent them the requested documentation.

As per the fedex tracking, the documents we sent were received by USCIS on May 18, But they still did not update the case status stating that they received the requested evidence.

Thanks for letting me know.

As per my HR manager, she mailed the documents on May 1 2007 and the status updated only on May 11 2007. I would say approx within 2 weeks?

RFE receipt date

My lawyer sent the RFE documents on 04/19/07 and USCIS received those on 04/28/07, per status on their website.

240 Days Rule

I read on this USCIS website that 240 days is the max you can be employed after your H1 expiry date. This is exactly what it says

(20) A nonimmigrant alien within the class of aliens described in paragraphs (b)(2), (b)(5), (b)(8), (b)(9), (b)(10), (b)(11), (b)(12), (b)(13), (b)(14), (b)(16), and (b)(19) of this section whose status has expired but who has filed a timely application for an extension of such stay pursuant to Secs. 214.2 or 214.6 of this chapter. These aliens are authorized to continue employment with the same employer for a period not to exceed 240 days beginning on the date of the expiration of the authorized period of stay. Such authorization shall be subject to any conditions and limitations noted on the initial authorization. However, if the district director or service center director adjudicates the application prior to the expiration of this 240 day period and denies the application for extension of stay, the employment aut horization under this paragraph shall automatically terminate upon notification of the denial decision. (Revised 1/1/94; 58 FR 69217)

This is the link to get to that website
