Responding to RFE - Which is better?

Hi,

I had an RFE for I-485 in March for 3 paystubs, EVL and tax docs.

I was laid off by previous employer last year. I found a job but "officially" started working as soon as I got the iEAD. It will take me three weeks to get a paystub. My fingerprints were on Jan 24, 2001. (now expired)

My question is:

Do I reply NEXT WEEK to the RFE (with the EVL from new employer, tax docs but NO PAYSTUBS)?

OR

Or Do I wait until END MAY and respond back to RFE with a paystub?

My thinking is maybe they have a window to work with the expired fingerprint cases and I can leverage that.

If the RFE specifically asked for 3 paystubs, you better wait for them.
I guess they asks for 3 paystubs assuming the payment is bi-weekly (most of the american companies have bi-weekly payment). But if your company has monthy payment, I feel two paystubs should be good enough. This is just my guess though. An experienced attroney can advice better.
If they didn't then you I feel EVL (stating your position and salary amount) + tax doc should be good enough.
 
I think you should send all documents INS is requesting of you.

Did you inform INS of your change of employer? Can u apply AC21 in your situation?

It's better to get yourself a lawyer to handle it.

I got laid off last 2001 and got a new job 2002. I didn't notify INS of my change of employer. I got RFE but only asking for EVL. So I sent EVL from my current employer. I got an interview 4/29. Went there.. said I need to start over. (meaning i got denied.. that's what i thought)

Then the next day, got a letter from INS saying they are reviewing my papers again and requesting me additional documents mostly from my current employer.

If you don't want yourself to be in the same situation as where I am right now. Get a lawyer to handle your case. It's a good thing that INS gives me a second chance.

Yes, I can use AC-21. I have to respond to RFE by end May.

I am planning to wait until end May and send my paperwork with an EVL from the new employer, my tax docs and ONE paystubs (cos one paystub is all I will have by then).
