I am new in this website, I am turning to you guys for advise because my wife may not eligible for her resident VISA because of US Law 9B2. I met my wife when I was in middle school in the USA, and we got married 6 months ago here in Costa Rica. We just moved here to Costa Rica in August but did not start filing for her Visa until just a couple of days ago.
In 1999 when she was 14 she immigrated into the USA illegally and stayed there until she was 20 years old. The Consul told us that she was not eligible to receive a VISA for another ten years because of her situation. This is because she is being punished under 9B2 and unless we can prove “extreme hardship” she can’t go back, I consider my wife and myself being separated for so long and not able to start a family because of separation quite extreme or the fact the I would have to move here to Costa Rica where my quality of life is not to the level that it would be in the USA because of job opportunities and many other things, but the consul said that they will most likely deny her waiver because we are so young.
I just thought I would turn to you guys for advise, and if you need any more information please feel free to ask and I would really appreciate any advise that you guys can give to us.
