Residency question

Hello,
Me, my son and my husband are green card holders. We have another 2 1/2 years to apply for citizenship. For family reasons, me and my son will have to stay for extended period (may be 2 1/2 years) of time outside the country. My husband will be here in US though. How can I maintain our residency ? Will it be valid if I come after every 6 months and stay in the U.S. for a month or so ? Does my son also have to come and stay here or can he get the citizenship automatically with us ?

I would really appreciate your help in this.
Thank you

Think logically....you know the answer!

Hi ada,
What I think about your questions is that everyone has to maintain the status regardless whether you got GC thru primary candidate or yourself. Since you got the GC, it is all indenpendent to maintain the status. Like you said, I also believe that you can come and stay for short perior here to maintain the GC staus...it\'s my personnel opinion. For any more advice, please consult your lawyer. Hope it helps!

Just staying here for a month or so every year is not enough. You should stay atleast 183 days per year to maintain your residency. Otherwise apply for re-entry permit. If your re-entry permit is approved then you can stay upto 2 years outside US without loosing residency.
