Residency on J1 visa!

Hi,

I have a question on J1 visa.I am done with my USMLE exams & in the process of applying for Residency.

1.lets assume that I have completed 4.5 years of H4 visa.I then take up residency on J1 visa.

When i complete residency and then apply for a Waiver job on a H1 visa(to avoid the 2 year Home return rule), what would be the duration of the H1 visa i would get for the waiver job?

Would it be a new H1 for 6 years or would it be for 1.5 years(6-4.5)?

Technically: the 6 years' clock of H1 resets when you are OUT of USA for 1 year. In this case, since you have not gone out of the US for 1 year, so the clock will not reset and probable H1 duration will be 1.5 years.

same problem has happened to many computer field people who came on H1, then due to lay-off go onto F1 status. on completing their F1 studies, when they want to go back to H1, the prior H1 period will be counted towards the 6 years.
