Hello,

My parents got their GC in spring of 2008. They came to US sometime in Jul or Aug. of 2008 with intention to stay for a while then go back for few months to avoid the winter here. Unfortunately their house was broken into and they had to leave in October. Their plan was to come back in Spring of 2009, but my father became very ill and had to be admitted in ICU for a week. The doctor restricted his travel and he hasn't made it back here yet. My mother came here in Sept. 2009 but wants to go back in Jan 2010 to take care of my father.

Now, since my father has been away for more than a year, what action can I take so he doesn't loose his GC? Can I file a 2 year re-entry permit now?
Also, since my mother hasn't lived here for significant amount of time, will she have a problem when she comes back in summer of 2010?

Thanks for all your help.

He will need to apply for an SB-1 visa to return to the US. Given his circumstances of being hospitalized and advised by the doctor not to travel, he shouldn't have a problem getting it approved if he can provide documented evidence of those facts.

Thank you Jackolantern.
Do you think my mother would have any hassles if she leaves in Jan 2010 and returns sometime in June/July, considering that she has been in the country for less than 6 months.
Thanks.

Citizenship could be a problem, but I don't expect she would have a problem returning to the US in June/July. She has been in the US for 3-4 months each in 2008 and 2009; she doesn't have a pattern of staying in the US for just 2 weeks and leaving again and again. But if they hassle her about it, she has an explanation.
