Residency H-1b Paperwork

Hello Everybody, I have matched in to a residency positon which sponsors an h-1b visa. the hospital does not however sponsor for the attorney costs. I am not to excited about having to pay several thousand dollars to an attorney.

1. Is it possible to centure process it on my own using the help of the GME/my department office?

2. I am trying to gather the paperwork for the application, I have asked them to start processing my temp training licensure but it will not be approved till july 1st. Would a letter from the state dept of health inidicating that I will get a licensure from july 1st be suffice?

3. Can somebody tell me the paperwork that is involved, can I get samples of letters of position? and department support letter?

Yes, this can be done, filling out an I129, obtaining an LCA and having the head of personnel sign it is certainly not rocket science, it doese however take some knowledge of how USCIS works.
Otoh, the fees for preparing a straightforward H1b are not that excessive, most attorneys will do it for somewhere around $1500-$2000.
The hospital HAS to pay all the fees (they have to be paid with a check drawn on the employers or attorneys account, they cannot be on your account).

It is my understanding that such a letter stating that you have fulfilled the requirements for licensure but that the license only becomes active on day1 of residency is sufficient. You will need step3.

- your employer needs to file for a labor condition application. You have to look up on the department of labors website on how to obtain that (here is where attorneys have an advantage, they just have a website where they plug in the numbers and get the approved LCA within minutes).

- your employer needs to file form I129, petition for nonimmigrant worker.

- your employer has to file to be exempted from the 'cap' based on the fact that they are a university or university affiliated institution.
