Request for Further Evidence, help!!!!

I phoned INS California Service Center to check the status of my I-140
petition, and from voice message it said a RFE had been mailed to me on Jan
19, 2002. I emailed my attorney, he said "Request for Further Evidence (RFEs) have become quite common"..., however 42 days have passed and my attorney still not receive the letter.

I asked him to take some actions, he told me he had (1) spoken to INS four times; (2) sent two letters; (3) continue to follow up every few days. As with every INS case, one way or another this will be resolved, but (as usual) it is not possible to say when. Simply put, INS is openly hostile right now. They are regularly denying I-140s. They generally offer no assistance if you contact them, and just don\'t really care very much since 9/11.

As I know, if 12 weeks are passed and INS still has not receive the RFE, it will deny my I140, I wonder what can I do? When I phone INS(1-949-831-8427), the phone is alway busy, why? which phone number should I use?

Escalation procedures

CSC has a set escalation procedure. Your attorney needs to work his way through it and then enlist the aid of the AILA CSC Liason if all else fails. If you do not respond to the RFE within 84 days your case will be denied.

But I don\'t think you can inquire on I140 as it\'s employer specific. Like Jim suggested you have to escalate the issue thru\' your attorney.

Sometimes for weird reasons, mails from INS get delayed. I received my I140 approval notice today, 1.5 months after the AVM said it was approved. But you can\'t wait any longer as RFE cases are denied if not responded within the time frame.

To get thru\' the INS phone line, it\'s not that simple my friend. You have to redial 100 times and then wait about 30 mins to get hold of an IIO.
