Request for evaluation for NIW

Hello,

I am working as a Software Engineer at a Fortune 500 company. I have H1B status. My employer has filed for labor certification but it has been pending for over four years. Also, with visa retrogression I am worried that it might take a long time to get my green card. I am thinking of applying for the NIW I-140 with my education and experience. Below is the summary of my qualifications. I would greatly appreciate it if you could evaluate it and let me know if this is a good case:

* BS in Computer Science
* MS in Computer Science with research assistantship position
providing full tuition waiver and monthly stipend
* Worked on research projects funded by National Institute of Justice and
State Department of Law Enforcement
* 90+ percentile scores in quantitative and analytical sections in GRE test
* 3 publications
* 1 conference presentation by invitation
* Working in a multi-state power distribution company with
responsibility in development and support of their critical systems
* Received appreciation letter from CIO of the company for
excellent support following hurricane Katrina
* Victim of hurricane Katrina
* 8 years work experience with specialization in
geographic information systems
* Reference letter from professor
* Reference letter from employer

Since I already have a labor certification pending, if my NIW I-140 gets denied will it affect my H1B status and/or labor certification and I-140/485 based on the labor certification ?

Any suggestion and/or advice would be very helpful for me. Thank you very much for reviewing my case.

Above two will not help to make u better candidate but makes you eligible.

past projects will not help....however, it can help to attest your qual as to acheive NI if any

not a big deal from INS point of view

* 1 conference presentation by invitation

actually not impressive

now you are talking about intrinsic merit and national interest for NIW

* Received appreciation letter from CIO of the company for
excellent support following hurricane Katrina
* Victim of hurricane Katrina

support and sucess wrt to your work/acheivements....then good but if its just social service ...it won't help!

NIW need more letter sfrom independent sources....at least 4-7.

No!
 
independent sources are the people
1. with whom You have never collaborated (may be same field) but are aware of you baceuse of your work.
2. can be industrial people who will be eventually interested your work.
3. also can be people who cited ur published work/patent etc for their work.

hey, i understand your pain and the trouble you are in. Labor
certification is the sickest thing I have seen so far in my life
in terms of any kind of processing time--in our countries you
can commit and get aquittal of 10 murders in the time it takes to
process on Labor cert.

I would suggest that if you want pick up a PhD even now. During
phd publish and you will have another OPT and another 2 yrs
left on your job and then apply for EB2-NIW.

stop the continuing pain of labor cert. over a couple of years. 4 years
is a lifetime in terms of experiences the time it takes for the IDIOTS
to approve one case.
