Reply from DHS

Following my call to USCIS customer service, I got a reply by mail from the DHS yesterday regarding my pending I485. My PD (Jan 14 2002) became current in April 2006. The reply read as follows

"Type of service requested: Case status - Outside Processing Time

"Based on the request we researched the status of this case. We are actively processing this case. However, we have to perform additional review on this case and this has caused a longer processing time. If you do not receive a decision or other notice of action from us within 6 months of this letter, please call customer service at the number provided below"

Does it mean my case is stuck in name check, or is it something else? This message is different from the standard reply they used to send before. Has anyone got a similar message? What happened after that? Any approvals, decisions, nothing? The last time my lawyer checked the status in October 2005 he had found out that my case was stuck in name check. Please advice,

Here is my optimistic view of our cases (mine also had the similar response from NSC), NSC has invented all kinds of language and tone on their responses, but in my opinion they mean what they say in the letter. In your case, I would say your name check is cleared ( otherwise they would say 'pending name check/security check'), and they are one step further in processing. Anyone disagrees? Good luck to you !

Yes, it is a standard reply. Too bad!! At least, my new address is up dated.
About the NC, I`ve got mine FP1 3 years ago that makes me believe it`s cleared. Good luck!
 
I tend to agree with IBelieve, I saw a few replies from USCIS to other members of this forum. The difference between other replies and the ones that I and IBelieve received is that "security check pending" is not mentioned in our cases. After so long, I am trying to hang on to the tiniest bit of optimistic information about my case. Maybe I'm being naive, we'll find out I guess.

When did you call the customer service? I opened a status inquiry on April 7th and I was told that it would take 30 days to get a response to my inquiry. My PD became current in March. Thanks.
 
I called USCIS customer service on 04/04/06 and I got the reply yesterday (17/04/06) by mail. Please let us know when you get your reply.
 
I got same response from CSC 2 weeks ago but insead of 6 months its 60 days processing time. I just called USCIS customer service and they told me that my Name check/security check is still pending with FBI. They actually opened my file and confirmed that its pending since Feb, 2005. :mad:

EB1UB, you said the customer service representative told you that your name check was still pending. Did you call the 1800 number? Did you get the information from the gentelman/lady first answered your call or you actually talked to a real immigration officer after your call got transferred? Thanks !
 
I called 1-800 number and followed instructions as posted previously. I got information from a gentleman. He might be IO since he had my name and told me when my Name check was initiated. I donot think CS representative would have your name??. He said everything else is fine and its normal these days for not receiving name check result over a year.

EB1UB: I received the same 6 mo letter yesterday from VSC. After reading what ur saying here, I conclude that I`m stucked in NC for more than 3 years. Is
that right? Another thing, the officer in CSC verifyed that your NC is pending since FEB05. Do you remember your FP1 date?

I don't think any EB2 approvals are coming up in NSC

Even after PD is current, I have not seen any EB2 approvals from NSC reported. Are people not reporting on this forum or there are no approvals from NSC or any other thing.

My inquiry ( 2nd) 4 months back : got following reply :

"Your petitions are currently pending, we will notify in writing when a decisions is made. Thank you for your patience "

Not sure if NC is cleared or not.

EB2: PD :March'02.

Thanks TV1 for the positive information. Hope all of us whose PD is current will get approvals soon as some others have. Can you please post your case details
 
I had that EXACT reply from NSC to "contact after 6 months ..."(which appears as if it came from some kind of TARROT READING or PARROT READING :) ) when lawyer initiated Status inquiry after PD became current.

It turned out the case is stuck due to Name Check pending :mad:
