Repercussions of abandoning GC

With the way things are going, I'm kinda getting frustrated. My PD is Nov. 2001 EB3-Ind. Everyday the urge to get out of this shackled lifestyle is growing within me. What will happen if I resign my job here and just go back to India. I will probably end up in a job that will require frequent visits to USA. Will that pose any problems ?

Which stage are you in ? I-485 pending ? Have you got the EAD ?

This country and their immigration policy really sucks with no promise. I don't want to be stuck with the employer that sucks blood just in the name of green card.

I just came back from India and things look very promising there. Lots have changed in terms of work environment etc and there is a visible improvement as far as infrastructure goes. We have decided to go back end of this year.

If you want to come back, as long as you have a visa, you should be ok. iWhen you leave your job, you also abandon the entire GC process and hence there shouldn't be any fresh status violation. Just my 2 cents.

Instead of leaving, don't you consider just getting another job here in the US using EAD instead ? I mean, the risks you would take, - even if taking a job somewhat similar instead of 'similar or same' - are minimal and perhaps that could greatly minimize your frustrations ? Instead of leaving, you could have the luxury or simply jumping in the first feasible job and not even bothering to send such EVL letter.

I am in the same boat than you. Back in September I had a chance to use AC21 and I was reluctant. If I came across the same opportunity today, I would invoke AC21 and get the job right away. Also, I am resuming my masters studies so I at least I keep my career going while stuck in this job.

Different priorities

Different priorities. This country's education system is not inspiring confidence in me. So my kids schooling also is a priority. Not to mention parents. In my mind I am going back. so there's no use of GC at all. GC is only relevant if u r staying here. Otherwise who cares. Why waste anymore time of ur life. Just sell everything and move back and start living ur life.

If you take up a job offer in india that requires you to travel to the usa, it would be a tricky situation.

I think if you have completed 6 years on your h1 visa, you will not be able to apply any kind of visa to the usa for a year. I am not 100% sure about this.

I have a similar situation and that is a huge drawback since most of the companies in india require me coming back to the US and they wont wait for 1 year for me to become eligible.

AGC4ME,
According to my lawyer, you could leave your job and move back home. DO NOT file I824 for CP. As long as you have a valid AP you should be able to come and leave when pleased.
Just make sure you renew your AP every year. (you have to be in the country when you apply for a new AP). You do not have to be employeed to get the AP renewed.
It sounds too good to me to be true but this is what my lawyer told me.

I agree GC is frustated,

at the same time I get frustated by many (so called highly educated) let employer's suck the blood, I am really serious,

do you guys realize many employer's are taking adavantage because you let them to, I understand for guys who can't file I-485, but if you have EAD and you filed I-485 more than six months ago, just use AC-21 and change your job.

if you want to go back to India, use AP and go back and should be able to return by keep renewing AP,

make sure you hire a good immigration attorney,
