Reopen an old case

Hi all,

I had sponsored my Sister,brother in law and their 07 kids for green card which went approved around 14 years ago but unfortunately they never appeared in the embassy for their interview .

My question is can i submit an application to reopen this case also at that time their 07 kids were under 21 years old but now they are above 21 years and 3 three of them are married .

Did they receive an appointment for the consular interview, and then didn't show up? Or is it that they never had any interaction with the consulate at all? Are they from Mexico or the Philippines?

The married children have definitely lost their eligibility, but the rest may have a chance depending on your answers to the above questions.

They never had any interaction with the consulate at all and they are from Pakistan .

From what I was told by a lawyer you get 1 year from the date of last interaction between the beneficiary and CIS/NVC before your petition is nulled. Interaction can be written or in person. If none of the beneficiaries or their derivatives have been communicating with NVC for more than a couple of years then it's gone. But I'm not sure about this and have never seen this information corroborated anywhere in writing.
 
It's too late for the kids, because the CSPA requires taking steps to pursue the visa or AOS within a year after the PD becomes current.

But your sister and her husband may still be able to immigrate if there was no communication between them and NVC/consulate. Contact the NVC.
 
Did you find out. I am in the same situation with my brother's visa. I went to counsulate and they said once the case is closed - all records are deleted after a year and therefore they can not do anything
