My 6 years term on H1B is going to expire in May 2003 and I don't have GC initiated as I got layed off recently.
I have an employer 'A' who has agreed to sponsor my H1b, assuming that I get my H1 approval for 3 years with this new employer can I enter in US after 1 year of my 6 years of h1B expiration ( for eg. I will leave US in the month of Feb' 2003 and would like to come back to US after 12 months on the new H1 approval from the employer 'A' . CAN I COME BASED ON NEW H1 APPROVAL EVEN THOUGH THIS H1B WAS FILED and APPROVED BEFORE MY 6 YEARS TERM EXPIRED?)
OR
DO WE NEED TO APPLY FOR FRESH H1B ONLY AFTER COMPLETING THE 6 YEARS.
