Hey I took volunteer departure back in 2006. I entered in U.S. In 2000 I entered in U.S. Under L1 visa my visa expired n I overstayed; we applied under labor. Just my husband got the work permit. my husband applied for Canadian immigration we got landed immigrant visa. We do cross border frequently plus we did fly too to visit my family in Houston. Never had any trouble. Last year I consult a lawyer regarding coming back to Houston permanently. He told me that I have 10 years bar even though I took volunteer departure. My 10 year bar is ending in November. My question is can apply for U.S. immigration few months a head before ending my time period? Please help me.

If you had 10 year ban, how could you enter to the country? When is your last visit?

We cross border very often by road and we did flew by air as well to visit my brother twice. I don't know why I have 10 years ban according to lawyer.

When you took voluntary departure, did you receive any paperwork? On there there would be summary of what you are charged and if there's a ban or not. If there's a ban and you are entering the country it might not be updated well in the system. You might not have a ban also. You have to figure this out before immigrating with your husband. What did your husband get?

My departure date was dec 22/2006 n we left the country on nov 11/2006.
My husband got order of immigration judge and at the back of this order it is written that remaining in the U.S. Beyond the authorized date will result in ur being found ineligible for certain forms of relief under the immigration and nationality act for a period of 10 years from the date of schedule departure.
Is that means we have 10 years ban??
