Renewal Of EAD

Hi,

I am in need of advice regarding the renewal of EAD.

My EAD is going to expire in another 3 months. As per the time frame given by INS, it should take 6 months for the renewal.

Please advise me, how can I apply for the renewal?

Can I apply for renewal by myself?

Do I need to apply for the renewal through a lawyer?

If I am not getting the Renewed EAD in time, so am I not permitted to work till I receive the EAD?

I heard about the IEAD. May I know, what IEAD is?

Will that do any help to my situation?


Please advise as soon as possible, as it seems like something to be done with immediate effect.

Apply ASAP as its taking more time for EAD renewal these days (4 to 5 months)

Yes you can.

Do I need to apply for the renewal through a lawyer?

Not really, you can apply it yourself and its fairly simple. I did it myself for me and my wife.

If I am not getting the Renewed EAD in time, so am I not permitted to work till I receive the EAD?

IEAD is interim EAD for someone who has not received an EAD extension in 90 days. If you have applied for an EAD extension 90 days before your current EAD expires you could get an interim EAD from the local INS and continue working till you get your EAD extended.

There are a lot of links on documents needed for EAD extension and stuff ... check for other postings....

Don't delay... apply ASAP, so that you will have a RD of atleast 90 days before the expiry date of the current EAD... Other wise you will have problem in getting IEAD before expiration of current EAD ( if your EAD is not approved)...

May I know, if I can file EAD by myself for the first time? What
are documents may be required to file?

Do I need to have recent pay-stubs to file EAD?
Will it be possible to file EAD first time online or will it be
required to go through the lawyer?

I am not sure if you are talking about EAD extension or a new EAD.

Following are the docs needed while applying for EAD extension.

• 2 photos which fits INS requirement with A# and name written with pencil on back.
• A check $120.00 for I-765 renewal fee made in the name of "Immigration and naturalization service"
• Original Form I-797 D (from last EAD)
• I -765 Renewal Application
• A copy of last EAD(front and back)
• A copy of Form I-94 Departure Record (front and back)
• A copy of I-485 Receipt Notice
• A copy of last I-765 Receipt Notice
• Marriage Cetificate for secondary applicant.


I believe there is no difference between applying for a new EAD
an extension.
 
I have two questions, While paper filing my EAD renewal form I-765 ????

My last entry which was on H1B, but now I am on EAD. Because my H1B period expired.

What would be the answer for Q15. Current Immigration Status?

What is the answer for Q16? Eligibility Categories ?
Is it (c)(9) in my case (I-485 pending). Am I right?

Please answer me for above questions???

Yes, you are right with (c)(9).

Is it (c)(9) or (c)(0)(9) . Which one is correct?
 
I had filed my first EAD extension through my lawyer and he for some reason put in (C)(c)(6) in the eligibility categories.

I guess ()(C)(6) or (C)(6)() all are ok.... check for other postings related to this.

I had put (c)(9), but my lawyer put it as (c)(0)(9)

AK2003.. Do you mean C09 and not "Nine" and Not "Six"... as EAD for employment based 485 case is C09....

I Have Patience,

I will say (C)(0)(9) is more accurate as if you see your current EAD the conditions are written as C09 and not as C9.... but my guess will be that is you write as (C)(9) that should also be OK...
 
Can I do it myself?

Hi,

So far all my processing used to be done by the attorney. Now, Attorney is not available. Now I have to do it by myself. I have to get my wife's EAD renewed. We do not have more than 3 months time. So ifever I try to engage another attorney the whole process may take more time and I am running out of time.

So the question are,

Can I file the EAD renewal by myself for my wife ?

If yes, Can I go to the Local INS office and submit it there in person?

Is it mandatory to engage an attorney for the renewal?

Where can I find the information of the office, where it was filed when it was filed for the first time.

If I am going to file it by myself in an INS Office different from the one where it was filed by attorney, will that cause any issue in renewal or delay in the remaining future process?

Typically, you can file anymore form yourself. But this immigration process being so complicated and confusing, it is so easy to make mistakes. the best bet is to do it through lawyers just as to be on safer side.

I think applying for EAD extension is a very simple process as far as i am concerned. If i could do it then any one could.

I just applied for myself and my wife. You just need to fill the form correctly and attach all the documents that are needed.
 
Last Date of Entry into US

Hi,

May I know, what will be the Last Date of Entry into US in filling the form for EAD Renewal?

I took the advice of a person, whose form was filled by an attorney.

According to him it was filled as date of the first entry into USA.

So the question is, did the attorney made a mistake in filling the form? otherwise, the first entry should be the last entry into US.

Date of last entry is the date you entered US the last time, i am pretty sure its not the date you first entered. Atleast i used the last date i entered into the usa and also my lawyer did the same.
