Renew H1 vs. EAD

My H1 will be expired in March 2002. I am planning to get ready renewing my H1 next month. But I just got a notice from the company lawyer stating that since I will be applying EAD after I received I485 receipt, he said I didn\'t need H1. I can use the EAD. (He told me it was the company\'s policy -company didn\'t want to help out in any H1B cases??!)

Although I intend to apply EAD, I don\'t want to use it just yet. I still want to keep using my H1. What should I do? Can I renew it on my own?

Do you have EAD already, if not, by the time your H1 expires, if you don\'t have EAD or H1, Can you continue to work based on just 485 filing receipt?????
 
EAD

If you don\'t get EAD within 90 days, you may go to a local INS office, and they will issue one. The problem will be only if the H-1 expires within those 90+ days and you don\'t have the EAD yet. In that case, you will not be authorized to work. However, you don\'t lose the status as you have already applied for 485.

Sorry..I wasn\'t in the office for the past few days as I have a seminar.

I just sent out a notice to my lawyer asking about my receipt and he told me that he already got the receipt "2 days ago". I should be able to receive it within 3 to 5 days. If I didn\'t ask my lawyer regarding my receipt, I don\'t think he will tell me anything! >:(

I will talk to my manager/HR dept regarding my H1B. At the mean time, I am going to apply EAD & AP at Boston INS. My wife has already found a job and as soon as she can get the EAD, she can start working next month (I hope)

Like I said, I don\'t intend to use my EAD yet so I still want to renew my H1B.

I just sent out a notice to my lawyer asking about my receipt and he told me that he already got the receipt "2 days ago". I should be able to receive it within 3 to 5 days. If I didn\'t ask my lawyer regarding my receipt, I don\'t think he will tell me anything! >:(
