Renew H-1 visa or renew EAD??

I thought I should get the GC when I submited the I485 in Jan,2002, but now it seems it is impossible.

My H-1B will be expired next march, and EAD will be expired next july, anyone here can tell me which one I had better to renew?

any experience to renew H1B and EAD?

Both!

The way things are going right now, it might be advisable to renew both. Your H1 is back up in case you are unfortunate enough to be rejected for your AOS thanks to the screw ups at INS/DHS. Your EAD in case you loose your job while waiting till hell freezes over i.e. your AOS gets approved.

I agree.. I was not planning to do either.. then my H1 expired and then I got laid off and then INS started this huge backlog.. I just sent my EAD renewal application so I can continue working for some other employer till my AOS is approved..

be on the safe side and go ahead and renew both.
 
h1 or Ead

U can go ahead and renew both... but if your AOS is denied... then INS will not let u work on H1, thus they will revoke it too. My lawyer had told me this... just wanted to share

Denial of AOS???

Now can someone please tell me under what circumstances can INS deny the AOS??? If someone has gone through the process of labor, I140 etc.. unless you have really screwed up between I140 and while someone at INS sees your application to adjudicate, can you really be denied. One thing comes to mind is if you mess up criminally and mess up with the law and end it leads to jail time.

Most of the time as long as you are just another run-of-the-mill applicant, you neednt worry about AOS being rejected.

About hiring a lawyer?? well you can do it for your H1 renewal.. dont waste money for EAD renewal on a lawyer.. its a pretty simple form and you can do it yourself. Make sure you are renewing your AP too.

aos denial ..possible

AOS denial is possible even without any messing up or criminal history. It just needs an incompetent attorney. Most AOS denials are because of the application being filed when the visa number is not available and the lousy INS not rejecting it when it receives, but do all the processing like FP etc and at the end of a long wait tell that the AOS has been denied.
