removal of GC condition..none residing with spouse, no lease or mortage together!

I need to apply for removal of condition on my GC. I have been married to my US citizen wife for 3 years and we have a son together. we live in a govt low income apartment before i got a job out of state that is like 3hrs drive from home. I share an apt with a friend 7mths ago and took my name off the govt low income apt to prevent two rents. I do spend 4days out of home and 3days at home with family. what could this done to my GC application?
 
Surely you must have some bills and bank statements showing that you live at the same address as your spouse? Those combined with your son's birth certificate should make it easy to get your I-751 approved.

I think that i have every other required documents by USCIS except lease/mortage. we ve checking&saving actt, utility bill, auto insurances on my wife apt. and most of my other stuffs are on the address also. i only use the address of my shared apt for my work correspondence only.

I hope you are following all of the rules about reporting your new income in the documentation for the low income apartment. Some of what you allude to is very suspicious. You cannot be married for immigration purposes and separated for qualifying for government benefits.

Im not separated from my wife. I just happened to be working out of home.

Do you think i shld indicate on my i-750 form that i have do stay out of home for work purposes?
 
It seems the low income apartment is your primary residence, as that is where your spouse and child are, and presumably that is where you keep most of your belongings, and you regularly return there 3 days a week. The other place where you spend 4 days is just for work purposes; you would get rid of it if you found a job close to the low income apartment, correct?

So list the place where you stay with your spouse as your address, and don't put the other one where you stay for work, as it is just temporary accommodation, not your actual residence.

But if you told the state you are separated from your wife, in order to avoid having them add your income to your wife's (which could reduce or eliminate the housing benefit), that is welfare fraud.

Do not worry, in the worse case you will be called for an interview. Go with your wife and son and slam dunk you will be approved.

Thanks for your response. On form i-751 part 5- Information about your children- List all your children. i think this is for someone who have kids with conditional GC as well. my son was born in US, i think that line does not applicable to my case. im i right?

In part 5 you are supposed to list all your children, whether they are inside or outside the US, whether they have a green card or not. For your children who are born citizens, you would write N/A for the A-number, and "US citizen" for the immigration status.
