Removal and deportation - please help

My friend, her husband and her daughter are in the deportation and removal stage which might turn out that they should be deported soon.

They have two kids who are US Citizen aged 6 and 8.

If deported;

1. Can their non-citizen daughter continue her study and finish high school and join college?

2. Is the 10 years bar automatically applied when the family get deported(denied asylum)?

3. Can the two US citizn kids apply for us when they reach 18? Will the deportation affect this option?

Sorry the non-citizen daughter cannot continue. She will be deported too. The 10 year bar is applied if they were in illegal status for certain period of time. Would need more details. The U.S Citizen can apply for you and your husband when they reach 18, however a denied asylum plus any overstays may require a waiver from the embassy.

NO, the kids who are american citizens can apply for the parent when they are 21, but you are their parents friends/or their friends, there is no visa catagory for friends of citizens - no immigrant visa atleast !


Are you the parents of the kids, or their parent's friends :confused:

Here is the detail:

They applied for asylum when they are in a valid status and they did not ovestay as the asylum process was on. After failing the interview with the asylum officer, they were sent to the immigration court and they asylum was denied. Now they are given 120 days for voluntary departure.

Their dialemma is:

Can they leave their non-citizen daughter tand somehow convert her visa to different type to enable her complete her study? Because she will never cope up with the school system of COP if returned as she started school here in USA?

As long as the deported was in a valid status when they applied for asylum, are they still barred for 10 years?

The American citizen kids could apply for their parent, I understand. But my question is as their parents are deported, does that mean the kids application when they reach 18 will fail because of previous deportation?

And what application for kids when they reach 18 are you talkng about? Thier for their parents? Since they(parents) have no overstays it should be ok, however, there is a question in the immigrant visa form that asks if you(the applicant migrating) have applied for fake asylum. Since you have no overstays it should be ok.

No overstay since they applied for asylum immeditaley after arrival. After deportation, can the parents apply for student visa for their daughter?

I still did not get one thing clear. If the parents are deported, does that mean they will be banned for 10 years automatically even if they never overstayed and evenif their asylum application failed?
