Relocation from NJ to Indiana

Dear Friends,

This is my first posting on this website, so please bear with me.

I applied my 485 in Jan 2002 and got a lay off in May 2002. I joined a small company for my payroll on ead. This arrangement continued upto July 2002. I finally got a job in Jan 2003 near Indianapolis. Some of my friends advised me to maintain my NJ apartment until I get the approval, so that I need not give AR11 to avoid some more additional delay in approval. So since Feb 2003 Iam paying rents for 2 apartments one in Indiana and another in NJ just for the sake of GC. Infact one of my friend maintained his NJ apartment for full 6 months after he actually got a job in Chicago.

My apartment lease expires on May 31,2003. I still don't see any hopes of getting my approval by that time. I have the following ideas

1 Extend the lease by another two months upto July 31st. If the approval comes by July end it is worth paying another 2 months rent in NJ. Actually my attorney was saying that there might be a transfer of my case to Newark as I changed the job before 180 days of filing 485. I guess if there is a transfer of case to Newark, it will take more time for the approval.

2. Move to Indianapolis and give AR11 form. My doubt was will my file be transferred to Nebraska Service center (Indiana comes under NSC's Jurisdiction). Some of my friends told me that it is always risky if there is a file transfer from one service center to another (like one of my friend's file was lost during the transfer process) and also it adds unneccessary delay for the approval.
Also I saw in some of the websites that NSC has recently denied the approval of 485 for a AC21 case.

3. Give one of my friends address who is in the same aparment complex as was my mailing address and submit AR11 form. I was thinking about this, because there would no transfer of case from VSC.

I would appreciate if you guys can suggest the best way out for me at this stage of 485 processing.
 
Sublet your appartment in NJ .....

Talk to your appt manager and see if they allow this.
Even if they dont allow you can find Desi folks willing to live
for short duration as guests. Nothing illegal in doing this.

Once you setup this arrangment, then just make sure that
whoever is living there opens the Mailbox everyday and give you your INS mail (and pay rent ) :D

if there is an interview and they ask for current job letter. the job is in Indiana with taxes being paid to Indiana. It is physically impossible for someone to be in two places at the same time. It definitely beats the purpose of AR-11.
When I move, i will file Ar-11 because i dont want further complications if there is an interview. Remember things re more strict now with the address changes.

The consulting company is a NJ based company, but the client is in Indiana. My family is still at the same NJ address.

If i give a change of address, don't u think that there might be a file transfer from VSC to NSC (Indiana comes under Nebraska service center) which itself is risky. Recently NSC denied a 485 case where the guy changed the job using AC21. Actually I myself got layoff from my sponsor before 180 days and I got this job in Indiana recently.

I would ask my lawyer abt your point.

Legally you are allowed to have ONE "Primary (permanent ? ) Residence" and if necessary temporary or secondary or whatever you would want to call that.
So no harm in maintaining 2 addresess at the same time.

All big consulting companies do this, infact there is a similar scenario in the Tax world called as "Per Diem" which relates more to "tax" issues arising due to the fact that people keep moving frequently as they are consulting .

Driver License is obviously a very trivial thing . Even if you are so particular about the Driver license, you can hang on to the NJ license. After all its just a matter of few more months as your RD is very close. ( I had hung on to my NJ licence for 2 years while I lived in a different state. This was sheer negligence and not for INS purposes. :D :D )

Also you dont need to "Hide" anything in case you are called for an interview at local INS.

You can always explain that your intentions of staying in NJ are
permanent and that you are ONLY temporarily working on a
Temporary assignment in Indiana for your consulting company in NJ.

And the fact that your consulting company is based in NJ substantiates this.

Most imporatntly you dont need to provide this explanation to VSC ! because you are still technically a resident of your current address in NJ.

Personally I would avoid filing AR11 and risk being transfered to NSC ...

Talk to your lawyer about this viewpoint see what he says...
