I have a few questions. Please help.

My : WAC 02-129*.
485 pending for last 18 mos.

Im primary applicant.

I may have to relocate to another state which comes under a different SC.

If I relocate I have to inform INS about my address change.

1. Will my 485 be transferred to a local INS office to the place I get relocated to ?

2. If I donot take relocation and take another job in CSC (where my 485 is filed), I know that comes under AC21 law. It was always said as to be in "same field". Does the designation also matter? Currently I am a developer, can I take a QA job, which requires some C++ or Java programming ? My LC states C++, Java Knowledge.

Please Help.

my 2 cents

mango,
1. Your case will be transferred to local office only if adjudicating officer at CSC decides for interview, otherwise it stays with CSC.
2. If you receive an RFE after changing jobs, you have to make EVL cover your original LC job.

Sometime back I read that moving to a different place is one of the main reasons for a case transfer to a local INS office.

Can somebody verify the above statement, please. Anyone had experiences with transfers because of a move? Please reply.

Thank You.

Mango,
I was in the similar situation , relocated twice with the same job while my GC was in process.
If you have any friends staying at ur current address , I would say keep the same addr for 485 and inform ur friend to send u any letters from INS to u..and whenever required, fly to CA.., thats what I did.

But its ur decision in the end, let us know what u decide.

I do no want to scare you with my comments

I differ with dmodi on keeping the same address as not revealing your current address to INS may be a cause for suspiscion/trouble if INS later finds out. In these days just go by the book and do not do anything which might give BCIS a reason to question your case.

These are just my 2 cents but it is based on my frustrating BCIS/INS experience.

Actually that is not necessarily true. People occasionally designate a constant address as the place they would like to receive their mail. It is not a stretch to use it to cover your residence address. Though you will have to file AR-11 with the correct address.

Secondly, the bigger problem I see is the Developer to QA! It is a huge change in job specifications, and you might want to make sure that your employers give you a EVL that states you do Development or will after getting your GC! AC21 works only if the job description is the same or nearly the same. Dev and QA are not similar by no stretch of imagination!

I can't ask my friends to look out my mail. Since I rent an apt. The moment I leave, I have no idea who steps in. So, I have to change my address.
And as 140 said, I will take up similar position. But can any body tell me if a move can cause transfer.
Also, are transfers good or bad?
My ND is March 02. If a transfer can speed up my 485, I can go for it.

What do you guys suggest AC21 or relocate with same company? Please reply.

Thanks

I'm in a similar solution - May 2002 RD, and working on EAD. I'm moving from CA to TX (same job and company) in a week. My lawyer says there is a possibility that the case may be transfered.

You mean, Case transfer to local INS in TX right? Not to Texas Service Center. I guess that is not possible or is it??

Not sure. I'll check with the lawyer on Monday. It does make more sense that it will be untouched in CSC until at least March 04 (for my case) and then they may transfer it to the local office in TX where it will gather dust for another year.

My 2 cents

These days, transfers are happening even if you don't change SC.
So, you can't make a career decision based on that. Only thing you have to make sure as others mentioned many times is to match the job description on LC when you present EVL.

Ideally you should have same address/employer/salary till GC approval. But these days, depending on your situation, you have to take some chances which may delay your approval.

When I lost my job, I had no option but to move out of CSC but made sure that I have "similar job". So I think the order of importance is Similar Job, Salary and then location.

My case is still pending, FP expired two months ago.
I informed about new address a month ago. My wife's EAD renewal came to new address in Minnesota this month.
