My mother-in-law's political asylum case based on Falun Gong was approved in 2002 at VSC.
I filed for I-485 for her and the case was transferred to Houston field office in 2004.
Then we moved to California in late 2004, and the case was further transferred to
San Francisco field office, it's still pending as of Feb, 2009. I've just contacted a local
congressman to initiate an inquiry on this case as it's past due.
I filed for I-730 asylee relative petition for my father-in-law, who lives in Shanghai.
The case was approved in late 2003, and an interview as scheduled at US Shanghai embassy
in Feb, 2004. We told every bit of background in details, and he was denied because
he was a communist party member, and had worked in the army before. The interview officer told him
"You were a party member, you were a policeman, either of this will deny your entry to U.S."
Now, since my mother-in-law has been living here for 7 years waiting for her
green card, we want to sponsor her husband to visit us via I-134 visitor visa application.
and will provide all the financial documents (employment letter, tax docs, pay stub,
invitation letter, etc). Yet the Shanghai embassy will have record
of his denied I-730 petition, and knew the fact that my mother-in-law came here and sought
asylum and stayed here.
I plan to write a personal letter to the officer stating the rational behind her asylum,
and profess that she would return to China when Falun Gong wasn't persecuted. And state that
her husband's case is different and he would return to China after 3 moths visit.
Does anyone have similar situation and know some insights and suggestions?
How should I better prepare for this case in order to get him to visit us successfully?
