I am an F1 student and enrolled for an undergraduate program. I have been in the U.S since the last 5 years and my Visa expired June 28 2005 and my I 20 will on expire June 30th 2005.
I was aware that its is possible to extend I-20, by showing new finance document as well as a progress letter from my academic adivosr stating that I have been making good progress toward my degree. However I have been unable to get the progress letter from my advisor as I have not completed enough courses towards my degree. I have just been diagnosed with a learning disorder in December 2004 and know that this has been the cause of my performance and withdrawing from school during 3 separate semesters.
Since I am unable to extend my I20 I have two options:
1. Apply for a reinstatement here in the United States
2. Make a re-entry into the U.S with a newly acquired F1 Visa from India.
My question is which would be a safer bet 1 or 2 ?
I am aware that I will have to show transcripts for re-instatement but if they are backed up by my Psychiatrist with medical paperwork for having a valid reason for my performance would I stand a chance? Also how long would the whole re-instatement process take?
I would greatly appreciate your views and advice.
