I am on F1 visa.Last year I got wed to an Indian whom holds a H1 visa.Due to financial situation,I managed to negotiate a payment plan with my university and hence was paying the tuition fees even till last month.I got pregnant last fall and could not attend my classes fully as I went till Nov 2004 only for that semester.Even though,I was paying the fees,the student accounts said that I could not register til I paid them in full.But I was attending classes even this spring and also at the moment,as I attain a letter from my professors stating my attendance and also abt the final exam scores
My husband and I was planning to change my visa to H4 and I contacted my uni's internation service.They all of sudden said that I am "out os status" (they said my sevis was removed in Nov 2004)and I need to seek and attorney regarding my case.I was tormrnted when I heard abt it as they werent being helpful at all,since I am fully unaware abt the protocols in this country.No one had called me or informed me regarding it while they know my demographic information.Besides that,there has been some politics running against me at my uni.This is due to the fact that I was supposedly to be a transfer student from my country as I had finished 3 1/2 yrs of education over there.But an officer in the Undergraduate Office declined my status and enrolled me as a freshman.I seek the assistance of my department's Chairman and finally under thepressurehe gave me an adddress where I could send my previous education for credit evaluation.
I had sent my evaluation to him in year 2003 itself,but he had stated that he has not received them while I have the status of the fax indicating that the documents has reached his office.I sent them once again,no feedbacks fro him at all.Meanwhile,my student advisors was changed several times,hence they could not bring this matter further.
At the International Student office,the director mentioned something bias abt her knowing the case and that she had spoken with the officer.I was so wail that I didnt wanted to ask her what was the converstaion about.Obviously ,they would support each other as they are collegues while I am a foreigner.
I spoke to a local attorney and he was strongly indicating that F1 student cannot be out of status when she is under unexpired F1 visa,currently paying the fees and also attending the classes with the permission of the profs.He wanted me to "reinstate" my F1.I called the International office and asked them abt my reinstate.They said they will get me a new I-20 and I have to show them some bank balance.He also said that the Officer in Undergraduate Office,is behaving so as he is seeking more funds from International students.
The question now is:
Can i convert to H4 after gettin my new I-20?
What will happen to my sevis record from Nov 2004?Wont it affect my future H1 process
Is it true that a student can reinstate when they are not properly guided educationally in a university?That they has valid medical reasons as well?
Am planning to go for a vacaton next year to my home country,will it an issue at the port of entry?
Please,sir,am seeking for your wise consultation as I am yet a studnet whom is in a position where I dont know where to move forward.With a newborn at home, am so depressed and am even planning to see a psychologist due to this reason.
