I hope someone can give an answer here.
This is the story. My PERM case was filed in February, 2006 with my previous employer. It was subsequently rejected and my employer opted to appeal the decision. I left the company in June. However, the appeal was approved after my departure (don't know exactly when it was approved). Now my previous employer now wants to hire me back.
Here are the questions.
1. With 45-day rule in effect, how to reuse the approved LC?
2. If not, what's the best course of action now, motion to reopen vs. re-application?
3. I have a little more than two years left on my H1B. If I choose to reopen the case, will I still have a chance to re-apply if reopening is rejected?
