I am a Canadian H1B holder and was terminated without cause November 2004. I left the US immediately and came back in, explained the situation at the border to customs that I was laid off and meeting with an attorney to discuss possibilities of bringing an action against my former employer, and the officer gave me B1 status on the spot until March 4. I entered under this status and was recently contacted by this same company. They now offered to hire me back in the same capacity and also, sponsor me for a green card. I am concerned about the following:
1) Will the visa cap that happened last October affect me
2) Would this involve having to apply for a brand new H visa, and then another petition for green card. And doesn't my B1 status actually cause this situation to be more complicated as a result?
