Hi everyone,
I need your advice regarding new regulations for Labor certification categories i.e. EB2 and EB3.
My company has applied for labor certification under EB3 category. With new rule regarding Visa Ret rogation green cards applied under EB3 categories won't be able to apply
for 485 until the labor application date is current.
I have Masters Degree in Computer Science from USA which means if my company had applied labor certification under EB2 category the same restriction wouldn't be applicable
on it.
Now, my company is willing to apply labor again under EB2 category but the problem is it hasn't advertised jobs under EB2 category lately. In short they have to go through
the whole process again.
Now as PERM date is fixed to last week of March or 1st week of April, Is it possible that they can go with advertisement process and apply for labor certification before
PERM rule comes.
Their scheduled advertisement went out last week of Dec 2004. The company lawyer is saying that they can not advertise twice in the same quarter.
Is this true or they just trying giving me some excuse?
Experts: I would appreciate your quick reply in case the company can advertise.
