I need some help in making a decision. My LC was filed under rgular processing in Kansas in Aug 2001. Now my employer has agreed to convert it to RIR and has asked for the job description. My concern now is this: To apply for RIR, should the ad be 6 months old or can we put the ad in the paper and immediately apply as an RIR? How long would processing take once the application has been selected for processing? I heard Chicago DOL is denying most of the RIRs, so is it good to go ahead? And, regular processing at Chicago DOL has not moved since October. Are they processing regular LCs at the DOL level?

And does any one have any idea when PERM is going to come into effect?

You need to show recruitment effort with in last 6 months. If you had placed ad. in newspaper in last six month, use it. Else start the ad. process and apply immediately. Attorney from your area can guide you better regarding how many ads.you need to post. Usually three in span of a month are good enough.


How long would process take once the application has been selected for processing?

Worth a try. You will save 8-10 months if they approve your LC in RIR.
