I employer applied my h1b in may 2004. We received an RFE in august and replied to it within 2-3 weeks. The uscis case status online shows that INs have received my response for RFE and its going to take about 150-180 days.
Since i had an RFE on my application. Am i eligible to expedite the process i.e premium processing.
My lawyer says that since we had an RFE there is no ways that INS will make it into premium processing ...is this ture ?
