Regular LC Application and Process

Folks: Need you help to understand better the LC Process. My company appleid for LC in April 2003 as REGULAR LC application in Virginia. RIR was considered kinda risky and therefore not recommended by the lawyer. Going at current speed, my case shall probably be looked at, Q1 of next yr or so. Questions:

1. What happens when the case is looked at? Does VA DOL send us (company) a letter to advertise for the position. How long does it take to send the letter out?
2. How long does the position need to be advertised. The company lawyers then have to deny the applicants (if any) and explain why to DOL, right?
3. How long does the whole process take before the State labor dept sends the application to the Regional Labor?
4. What does the regional Labor dept do then? Phili is also backed up I know.

... SESA (SWA) will instruct employer/attorney to advertise in local print media after going through application. Check VA thread for timing/date issues.

... Employer/Attorney will get date/duration in the letter from SESA (SWA). Employer is required to go through each resume and make decision, and document the process.

3. How long does the whole process take before the State labor dept sends the application to the Regional Labor?
... After getting recruitment effort details back from employer/attorney, SESA (SWA) will either approve the petition (and forward to DOL) OR raise issue by sending RFE or deny the application. If everything is OK, they will forward application right away.

4. What does the regional Labor dept do then? Phili is also backed up I know.
... Regional DOL will check the application and stamp it with RD (after assigning case #). They will come back to applcation once dates are current and check the conditions set for LC. Depending upon case they can approve, deny or issues NOF.
