Regarding re-entry to US

hey guys,


I have interview for immigrant visa next week. I want to know certain things after getting the visa..

1.) what is the minimum time after which we can come back to homeland after visiting to US and getting the GC.

2) I hear that u hav to apply for a permanent green card while ur in US. So can i apply for GC and SSC the very next day i land in US and comeback to india as i have some unfinished tasks here.

3) My sister is in her second yr of gradutaion so she also needs to come back and that too for a a duration of arnd 3-3.5 yrs. So what is the best option for her.

4)My brother is doing a job and he has signed some kind of bond with that company. He also needs 1.5 more years to completely shift to USA.

Anybody plz help. Thnx in advance.
 
See the answers in bold below. Note that the immigrant visa is given to people who are coming to make the USA their home, it is not meant to be a visa. You can lose your permanent residency if immigration feels by your actions that you do not plan to make the USA your home

You will need to apply for SSC and wait to get your card although you can leave before getting the card in your hands,

2) I hear that u hav to apply for a permanent green card while ur in US. So can i apply for GC and SSC the very next day i land in US and comeback to india as i have some unfinished tasks here. Yes you can, but you won't be getting them that day. Will take a few weeks to a few months to get them in your hands

3) My sister is in her second yr of gradutaion so she also needs to come back and that too for a a duration of arnd 3-3.5 yrs. So what is the best option for her. She needs to get a reentry permit which is good for two years and then she will have to come back and get another one for another two years. Getting the second one is not guaranteed though

4)My brother is doing a job and he has signed some kind of bond with that company. He also needs 1.5 more years to completely shift to USA. See Answer to question 3 above. If he tells immigration that, they will refuse him his green card. Taking a job abroad can be construed to be abandoning your permanent residency

You can leave immediately after being admitted to the US.

After the immigrant visa is approved, you have six months to enter the US, so it may be better to spend some of those months to finish up your tasks before traveling to the US, instead of going to the US and having to leave again right after.

After you are admitted to the US with an immigrant visa (which you already obtained after interviewing at the consulate), the green card will be automatically mailed to your US address within a few weeks. The SS card will also be automatically mailed if you requested it on form DS-230 which you submitted to the consulate before the interview. So there is no need to apply for the green card or SS card after arrival in the US.

Is she also interviewing for an immigrant visa at nearly the same time as you?

Or he can move to the US, get a job and pay them off, which might not be a lot of money when converted to US dollars. Or just ignore them because they can't touch him in the US. He could lose his green card because of working abroad, so he should find a way to end that arrangement within a few months.

Is there any way in which he can do job fr the nxt 1.5 yr and then move back to USA permanently bcz he is a fresher.
It ll be difficult for him to get a job in USA right away.

No need to quit the job before the interview. As I mentioned above, upon approval of the immigrant visa, he will have 6 months to enter the US. So he can continue to work outside the US for those 6 months without a problem.

After arrival in the US he can get a reentry permit that would allow him to stay outside the US for 2 years. However, obtaining the reentry permit requires staying in the US for about 3-5 weeks (or taking trips back and forth during that time), and even with the permit working abroad for an extended period could still result in loss of the green card.

If he uses the 6 months I mentioned above to diligently search for jobs, he might find one before he arrives in the US (or at least have an interview lined up).
